1. Agreement to Terms
By accessing or using KorField Pro ("Service," "App," or "Platform"), operated by Kor Software Solutions LLC ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access or use the Service.
These Terms apply to all users of the Service, including business owners, field technicians, and customers using the portal.
2. Description of Service
KorField Pro is a field service management software-as-a-service (SaaS) platform designed to help service businesses manage:
- Client and customer relationships
- Job scheduling and dispatch
- Invoicing and payment processing
- Field technician coordination
- Inspections and service reports
- Document and photo management
- Customer portals and communications
3. User Accounts
3.1 Account Registration
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
3.2 Account Types
We offer different account types with varying features and permissions. You are responsible for choosing the appropriate account type for your needs.
3.3 Phone Number Verification
If you provide a phone number for account authentication or notifications, you agree to receive SMS text messages from KorField Pro, including:
- Authentication codes and security alerts
- Appointment reminders and job notifications
- Service updates and important account information
You confirm that you are authorized to receive text messages at the phone number provided. Standard message and data rates may apply.
4. Acceptable Use
4.1 Permitted Use
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Upload malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to the Service
- Interfere with or disrupt the Service or servers
- Use the Service to spam or harass others
- Impersonate any person or entity
- Collect user information without consent
- Use automated systems to access the Service without permission
4.2 Business Use
The Service is intended for legitimate business purposes. You agree to use it in compliance with all applicable industry regulations, employment laws, and data protection requirements.
5. Subscription and Payments
5.1 Subscription Plans
Access to certain features requires a paid subscription. Subscription details, including pricing and features, are available on our website and may change with notice.
5.2 Billing
By subscribing, you authorize us to charge your payment method on a recurring basis. You agree to:
- Provide accurate payment information
- Pay all fees when due
- Update payment information to avoid service interruption
- Pay any applicable taxes
5.3 Payment Processing
Payments are processed through third-party payment processors (such as Stripe). You agree to their terms of service and privacy policies.
5.4 Refunds
Subscription fees are generally non-refundable except as required by law or at our sole discretion. Contact us to discuss any billing concerns.
5.5 Cancellation
You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period.
6. Data Ownership and Rights
6.1 Customer Data Ownership
You retain all right, title, and interest in and to your Customer Data. "Customer Data" means all data, information, and content you upload, create, or store in the Service, including but not limited to client information, job records, documents, photos, invoices, and any other data entered into the platform.
We do not claim any ownership rights over your Customer Data. Your relationship with your customers and the data you collect from them is solely between you and your customers.
6.2 License to Process Data
By uploading Customer Data, you grant us a limited, non-exclusive, royalty-free license to:
- Store, process, and transmit your Customer Data
- Display your Customer Data to you and authorized users on your account
- Perform technical operations such as backup, recovery, and security measures
- Create anonymized, aggregated data for analytics and service improvement (without personally identifiable information)
This license exists solely to enable us to provide the Service and terminates when you delete the data or close your account.
6.3 Your Responsibilities
You are solely responsible for your Customer Data and represent and warrant that:
- You have the right to collect, use, and share the Customer Data as required to use the Service
- You have obtained all necessary consents from your customers for data collection and processing
- The Customer Data does not violate any laws, regulations, or third-party rights
- The Customer Data is not defamatory, obscene, or unlawful
- You comply with all applicable data protection laws (including GDPR, CCPA, etc.) in your collection and use of customer data
6.4 Data Retrieval and Portability
You may export your Customer Data at any time through the Service's export features. Upon request during an active subscription, we will provide reasonable assistance in retrieving your data in a commonly used format.
6.5 Data Backup
We perform daily backups of Customer Data stored in the Service. However, you are responsible for maintaining your own independent backups of critical Customer Data. We are not liable for any data loss except as expressly provided in these Terms or required by law.
6.6 Data Deletion
Upon termination or expiration of your subscription, we will retain your Customer Data for 30 days to allow you to reactivate or retrieve your data. After 30 days, all Customer Data will be permanently deleted from our systems, except where we are required to retain it by law.
7. Intellectual Property
The Service, including its design, features, code, and content (excluding User Content), is owned by Kor Software Solutions LLC and protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or create derivative works from the Service without our express written permission.
8. SMS and Communications
By providing your phone number and using the Service, you consent to receive SMS text messages for:
- Account authentication and security verification
- Appointment and job reminders
- Service notifications and updates
- Critical account alerts
You may opt out of non-essential notifications through your account settings. However, you may still receive essential security and authentication messages.
Message frequency varies. Message and data rates may apply according to your carrier's plan. Carriers are not liable for delayed or undelivered messages.
To opt out of SMS notifications, text STOP to the number from which you receive messages, or adjust settings in your account.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
10. Third-Party Services
The Service may integrate with or contain links to third-party services (payment processors, mapping services, authentication providers). We are not responsible for the content, policies, or practices of these third parties.
11. Service Level and Availability
11.1 Service Uptime
We strive to maintain 99.5% uptime for the Service, measured monthly, excluding scheduled maintenance windows. "Uptime" means the Service is accessible and operational for authorized users.
Scheduled Maintenance: We may perform scheduled maintenance during which the Service may be unavailable. We will provide at least 24 hours' notice for planned maintenance, except in emergencies.
11.2 Unscheduled Downtime
The Service may be temporarily unavailable due to:
- Emergency maintenance or security updates
- Third-party service provider outages
- Network or infrastructure failures beyond our control
- Distributed denial of service (DDoS) attacks or other security incidents
We do not guarantee uninterrupted access and are not liable for losses due to service interruptions, except as expressly stated in these Terms.
11.3 Support
We provide technical support via email during business hours (Monday-Friday, 9:00 AM - 5:00 PM Pacific Time, excluding holidays). Response times vary based on issue severity and subscription plan.
11.4 Changes to Service
We reserve the right to modify, enhance, suspend, or discontinue any feature or aspect of the Service at any time. We will provide reasonable advance notice for material changes that negatively impact core functionality.
11.5 Account Suspension
We may suspend or terminate your access to the Service immediately and without prior notice if:
- You violate these Terms or applicable laws
- Your account is delinquent on payment
- Your use poses a security risk or threatens the integrity of the Service
- You engage in fraudulent, abusive, or harmful activities
- Required by law or court order
Upon suspension for Terms violations, you will have 7 days to cure the violation before account termination.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOR SOFTWARE SOLUTIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify, defend, and hold harmless Kor Software Solutions LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Your User Content
15. Dispute Resolution
15.1 Informal Resolution
If you have a dispute with us, please contact us first to attempt an informal resolution.
15.2 Arbitration
Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial or to participate in a class action.
15.3 Exceptions
Either party may seek injunctive relief in court to protect intellectual property rights.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Kor Software Solutions LLC is registered, without regard to conflict of law principles.
17. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.
18. Termination
You may terminate your account at any time by contacting us or using the account deletion feature. Upon termination:
- Your access to the Service will cease
- Your data will be deleted within 30 days (see Privacy Policy for details)
- Outstanding fees remain due
- Provisions that should survive termination will remain in effect
19. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kor Software Solutions LLC regarding the Service and supersede all prior agreements.
